SUBPART 80-2
REQUIREMENTS FOR TEACHERS’ CERTIFICATES APPLIED AND QUALIFIED FOR ON
OR BEFORE FEBRUARY 1, 2004

Section 80-2.1 Application of this Subpart and
definitions.
(a) Application of this Subpart.
(1) Provisional certificates.
(i) Candidates who apply for provisional teachers' certificates valid for classroom teaching service on or before February 1, 2004, and who upon such application qualify for such provisional certification effective on or before February 1, 2004 shall be subject to the requirements of this Subpart. Candidates who do not meet these conditions shall be subject to the requirements of Subpart 80-3 of this Part, unless otherwise specifically prescribed in this Part.
(ii) Candidates who apply for the provisional certificate in the title school administrator and supervisor on or before September 1, 2006, and who qualify for such provisional certification on or before September 1, 2007 shall be subject to the requirements of this Subpart. Candidates who do not meet these conditions shall be subject to the requirements of Subpart 80-3 of this Part, unless otherwise specifically prescribed in this Part. The requirement that the candidate must apply for the provisional certificate in the title school administrator and supervisor on or before September 1, 2006 shall not apply to a candidate who has completed a program leading to that certificate registered pursuant to Part 52 of this Title. In that case, the candidate must apply for the certificate on or before September 1, 2007 and also qualify for the certificate on or before September 1, 2007 to be subject to the requirements of this Subpart.
(2) Permanent certificates.
(i) Candidates who apply for permanent teachers' certificates in the classroom teaching service shall be subject to the requirements of this Subpart, provided that they have been issued a provisional teacher's certificate in the title for which the permanent certificate is sought and have met all requirements for the permanent certificate on or before February 1, 2004 or while under a provisional certificate that was in effect after that date. Candidates who do not meet these conditions shall be subject to the requirements of Subpart 80-3 of this Part, unless otherwise specifically prescribed in this Part.
(ii) Candidates who apply for permanent certificates in the title school administrator and supervisor shall be subject to the requirements of this Subpart, provided that they have been issued a provisional certificate in this title and either have met all requirements for the permanent certificate on or before September 1, 2007 or while under a provisional certificate that was in effect after that date. Candidates who do not meet these conditions shall be subject to the requirements of Subpart 80-3 of this Part, unless otherwise specifically prescribed in this Part.
(iii)
(a) Candidates who apply for permanent certificates in the title school district administrator on or before September 1, 2006, and who qualify for such permanent certification on or before September 1, 2007 shall be subject to the requirements of this Subpart, except in cases prescribed in clause (b) of this subparagraph for which the time period for qualifying for permanent certification is extended. The requirement that the candidate must apply for the permanent certificate in the title school district administrator on or before September 1, 2006 shall not apply to a candidate who has completed a program leading to that certificate registered pursuant to Part 52 of this Title. In that case, the candidate must apply for the certificate on or before September 1, 2007 and also qualify for the certificate on or before September 1, 2007 to be subject to the requirements of this Subpart.
(b) Candidates who apply for permanent certificates in the title school district administrator on or before September 1, 2006, and upon application are certified or otherwise authorized by law to serve as school business administrators, are serving as school business administrators, and meet all requirements for the permanent certificate as a school district administrator except the experience requirement, shall have until September 1, 2010 to qualify for the permanent certificate as a school district administrator under the requirements of this Subpart.
(c) Candidates who do not meet the conditions of clause (a ) or (b) of this subparagraph shall be subject to the requirements of Subpart 80-3, unless otherwise specifically prescribed in this Part.
(iv) Candidates who apply for permanent certificates in the title school business administrator on or before September 1, 2006, and who qualify for such permanent certification on or before September 1, 2007 shall be subject to the requirements of this Subpart. Candidates who do not meet these conditions shall be subject to the requirements of Subpart 80-3 of this Part, unless otherwise specifically prescribed in this Part. The requirement that the candidate must apply for the permanent certificate in the title school business administrator on or before September 1, 2006 shall not apply to a candidate who has completed a program leading to that certificate registered pursuant to Part 52 of this Title. In that case, the candidate must apply for the certificate on or before September 1, 2007 and also qualify for the certificate on or before September 1, 2007 to be subject to the requirements of this Subpart.
(3) Candidates who were matriculated in a program registered pursuant to Part 52 of this Title as leading to certification in the classroom teaching service whose participation in that program was interrupted by mobilization in active military service between September 11, 2001 and February 1, 2004 shall be granted an extension of time to complete the requirements under this Subpart for the provisional or permanent certificate in the classroom teaching service equal to the amount of time the candidate was in active military service, provided the candidate provides the department with adequate documentation verifying the effective dates of such military service and matriculation in the registered program when mobilized for active military service. Such extension shall commence on September 1st, immediately following the concluding date of the candidate's active military service.
(4) Candidates who apply for a provisional or permanent certificate valid for pupil personnel service shall be subject to the requirements of this Subpart.
(b) Definitions. The definitions prescribed in section 80-1.1 of this Part shall be applicable, unless otherwise prescribed in section 80-1.1 of this Part.

Section 80-2.2 General requirements.
(a) The requirements for the permanent certificate shall be those in effect at the time the provisional certificate for the certificate title sought is issued.
(b) The requirements set forth in Subpart 80-1 shall be applicable unless the subject matter or terms of such requirements prescribe otherwise.
(c) The requirements for extensions or annotations of teachers' certificates set forth in Subpart 80-4 of this Part shall be applicable for candidates who apply for extensions or annotations on or after February 2, 2004. The requirements for extensions or annotations of teachers' certificates set forth in this Subpart shall be applicable for candidates who apply for extensions or annotations of teachers' certificates on or before February 1, 2004, and who upon such application qualify for such extensions or annotations.
(d) Validation and comparability of licenses granted for the city school districts of New York and Buffalo.
(1) A license issued pursuant to the Education Law by the superintendent of schools of the city school district of Buffalo or, prior to February 14, 1991, by the chancellor of the city school district of the City of New York shall be valid for service in any school district in the State for which a comparable State certificate is required, provided such license has been issued upon qualifications which are at least substantially equivalent to those required for such certificate pursuant to these regulations. Except as provided in paragraph (2) of this subdivision, comparability of the State certificate pursuant to this Part and the license granted by such school districts shall be determined by the commissioner.
(2) In accordance with Education Law, section 2569(a), the following tables set forth the licenses utilized by the city school district of the City of New York and the corresponding State certificate titles:

Teacher Liaison Any Valid Certificate (e) Provisional certification through certification by other states. Candidates who apply for a provisional certificate in a certificate title prescribed in this subdivision on or before February 1, 2004 may apply for such certification pursuant to the requirements of this subdivision.
(1) For provisional certification in a certificate title in the classroom teaching service for which this Part requires completion of an examination requirement, the commissioner may issue to a candidate who has not met such examination requirement a two-year nonrenewable conditional provisional certification, notwithstanding that the examination requirement has not been met, and deem that all other requirements for the provisional teacher's certificate in the certificate title in the classroom teaching service have been met, provided that the candidate holds a valid regular teacher's certificate in the same or an equivalent title by a state which has contracted with the State of New York pursuant to section 3030 of the Education Law, the interstate agreement on the qualifications of educational personnel, and provided further that such regular teacher's certificate issued by the other state evidences knowledge, skills, and abilities comparable to those required for certification in New York State. To meet the requirements for a full provisional certificate in such certificate title, the candidate shall be required to submit to the commissioner, at least 60 days prior to the expiration of the conditional provisional certification, satisfactory evidence of meeting the examination requirement for the provisional certificate title sought, as prescribed in this Part. If the candidate meets such examination requirement, the commissioner shall issue a provisional certificate for the term commencing on the day after the expiration date of the conditional provisional certificate and ending five years after the effective date of the conditional provisional certificate. This paragraph shall not apply to a candidate who holds a temporary license to teach in a professional position in the classroom teaching service on or after March 8, 2000.
(2) For provisional certification in a certificate title in the classroom teaching service for which this Part does not require completion of an examination requirement, the commissioner may deem that all requirements for the provisional teacher's certificate in the classroom teaching service have been met by a candidate who holds a valid regular teacher's certificate in the same or an equivalent title by a state which has contracted with the State of New York pursuant to section 3030 of the Education Law, the interstate agreement on the qualifications of educational personnel, provided that such regular teacher's certificate issued by the other state evidences knowledge, skills, and abilities comparable to those required for certification in New York State.
(3) The commissioner may deem that all requirements for a provisional teacher's certificate in a title in the classroom teaching service have been met by a candidate who holds a valid teacher's certificate in the same or an equivalent title issued by any state and also holds a certificate in the same or an equivalent title issued by the National Board for Professional Teaching Standards.
(4) A candidate may meet the educational preparation requirements for a provisional certificate in a certificate title prescribed in this Part by successfully completing a program of educational preparation for a teacher's certificate in such certificate title or its equivalent at an institution of higher education approved pursuant to section 3030 of the Education Law, the interstate agreement on the qualifications of educational personnel. In order to be eligible for a provisional certificate such candidates shall be required to meet all other requirements for the provisional certificate as prescribed in this Part, which may include but are not limited to an examination requirement.
(5) A candidate who meets provisional certification requirements through meeting the requirements of this subdivision shall be required to meet the regular requirements for permanent certification set forth in this Part.

Section 80-2.3 Certificates valid for pupil personnel
service (school attendance teacher, school counselor, school dental
hygiene teacher, school nurse-teacher, school psychologist and school
social worker).
Section 80-2.3 Certificates valid for pupil personnel service (school attendance teacher, school counselor, school dental hygiene teacher, school nurse-teacher, school psychologist and school social worker).
Preparation: to obtain a certificate in a pupil personnel service, a candidate shall meet the requirements set forth in this section.
(a) School attendance teacher.
(1) Provisional certificate.
(i) The candidate shall hold a baccalaureate degree from a regionally accredited institution of higher education or from an institution approved by the department and shall have completed in addition/or including six semester hours of professional education appropriate to the function of the school attendance teacher.
(ii) Time validity. The provisional certificate shall be valid for five years from date of issuance.
(2) Permanent certificate. The candidate shall have completed, in addition to the requirements for the provisional certificate, two years of school experience in the field of pupil personnel services and a master's degree in the field of pupil personnel service.
(b) School counselor.
(1) Provisional certificate.
(i) The candidate shall hold a baccalaureate degree from a regionally accredited institution of higher education or from an institution approved by the department, and in addition shall have completed 30 semester hours of approved graduate study in the field of school counseling, including supervised practice in guidance.
(ii) Time validity. The provisional certificate shall be valid for five years from date of issuance.
(2) Permanent certificate. The candidate shall have completed, in addition to the requirements for the provisional certificate, two years of school experience in the field of pupil personnel services and 30 semester hours of graduate study in the field of school counseling. Within the total program of preparation, the candidate shall have been awarded a master's degree.
(c) School dental hygiene teacher.
(1) Provisional certificate.
(i) The candidate shall have completed, in addition to an associate degree at an institution approved for the preparation of dental hygienists, 30 semester hours of collegiate study toward meeting the requirements for a baccalaureate degree, including six semester hours of professional education appropriate to the function of the school dental hygiene teacher.
(ii) The candidate shall hold a valid New York State registration as a dental hygienist.
(iii) Time validity. This certificate will be valid for five years from date of issuance.
(2) Permanent certificate. The candidate shall have completed, in addition to the requirements for the provisional certificate, two years of school experience in the field of pupil personnel services and a four-year program of preparation culminating in a baccalaureate degree from a regionally accredited institution of higher education or from an institution approved by the department. Within the total program of preparation, the candidate shall have completed 18 semester hours of professional education appropriate to the function of the school dental hygienist.
(d) School nurse-teacher.
(1) Provisional certificate.
(i) The candidate shall hold a baccalaureate degree from a regionally accredited institution of higher education or from an institution approved by the department, including six semester hours of study in professional education appropriate to the function of the school nurse-teacher.
(ii) The candidate shall hold a valid New York State registration as a professional nurse.
(iii) Time validity. The certificate shall be valid for five years from date of issuance.
(2) Permanent certificate. The candidate shall have completed, in addition to the requirements for the provisional certificate, two years of school experience in the field of pupil personnel services and a master's degree in the field of pupil personnel service.
(e) School psychologist.
(1) Provisional certificate.
(i) The provisional certificate shall be valid for five years from the date of issuance.
(ii) The candidate shall hold a baccalaureate degree from a regionally accredited institution of higher education or from an institution approved by the department, and shall have completed in addition 60 semester hours of graduate study, including a college-supervised internship in the field of school psychology.
(iii) Exception for licensed psychologists with demonstrated bilingual skills.
(a) In lieu of meeting the education requirements prescribed in subparagraph (ii) of this paragraph, a candidate may meet the following requirements for a provisional certificate as a school psychologist:
(1) the candidate must request in writing an exception to stated preparation under this subparagraph;
(2) the candidate must submit an application for a provisional certificate to the department;
(3) the candidate must be registered and hold a New York State license as a psychologist, pursuant to title VIII of the Education Law;
(4) the candidate must document a commitment for employment as a school psychologist by a school district or other entity required by law to employ certified school psychologists in which the employer agrees to provide the candidate with mentoring by a certified school psychologist in the first year of employment under the provisional certificate; and
(5) the candidate must meet all requirements for an interim bilingual education extension, as prescribed in section 80-2.9(a)(5) of this Subpart, except the requirement that the candidate hold a provisional or permanent certificate as a school psychologist.
(b) A candidate who meets the requirements of clause (a) of this subparagraph shall be issued both a provisional certificate in school psychology and an interim bilingual education extension. The provisional certificate shall have the duration prescribed in subparagraph (i) of this paragraph. In accordance with the requirements of section 80-2.9(a)(5) of this Subpart, the interim bilingual education extension shall be valid for three years from its effective date and shall not be renewable.
(c) No provisional certificate in school psychology with an effective date that begins after September 1, 2010 shall be issued under the requirements of this subparagraph, and no interim bilingual education extension with an effective date that begins after September 1, 2010 shall be issued under the requirements of this subparagraph.
(2) Permanent certificate. The candidate shall have completed, in addition to the requirements for the provisional certificate, two years of school experience in the field of pupil personnel services. Within the total program of preparation, the candidate shall have been awarded a master's degree.
(f) School social worker.
(1) Provisional certificate.
(i) The candidate shall hold a baccalaureate degree from a regionally accredited institution of higher education or from an institution approved by the department, and in addition shall have completed 30 semester hours of graduate study, including a supervised internship, in the field of social work.
(ii) Time validity. The provisional certificate shall be valid for five years from date of issuance.
(2) Permanent certificate. The candidate shall have completed two years of school experience in the field of pupil personnel services, hold the degree of master of social work or an equivalent degree as determined by the department, and be licensed and registered by the department as a licensed master social worker or a licensed clinical social worker.
(3) Scope of practice. The provisional or permanent certificate in school social work shall authorize the holder of the certificate to practice licensed master social work, as defined in sections 7701(1) and 7702 of the Education Law, in public schools of New York State or any other school for which the law requires certification as a school social worker pursuant to Part 80 of this Title. For such individual to practice licensed clinical social work, as defined in section 7701(2) of the Education Law, in the public schools or any other location in New York State, the individual must be licensed and registered by the department as a licensed clinical social worker when performing such services, unless such individual is exempt from licensure in licensed clinical social work pursuant to section 7706 or other provision of article 154 of the Education Law.
