D1. Can LEAs and BOCES continue to employ certified CTE teachers who are not “highly qualified?”

Yes.  Such teachers are certified by the State to teach CTE courses.

  • They may teach CTE courses that are not subject to the NCLB without any further qualification.
  • If they teach a CTE course that is subject to the NCLB, they must collaboratively plan and deliver the course with a teacher who is “highly qualified” in the academic subjects covered by the course, as described in Item C3.
D2. Can LEAs and BOCES continue to offer CTE courses that may be used for academic credit?

Yes.  The NCLB does not change the Commissioner's Regulations that permit these types of courses. The NCLB adds requirements for teachers of these types of courses.

D3. Can students continue to receive academic credit for CTE courses?

Yes.  Students may continue to receive academic credit for such courses when the courses comply with the Commissioner's Regulations and related guidance.
