E. Which paraprofessionals must meet the NCLB's requirements?
  1. PARAPROFESSIONALS PROVIDING INSTRUCTIONAL SERVICES. Section 80-5.6 of the Commissioner's regulations define certificate titles, certification requirements and the scope of practice for supplementary school personnel, including paraprofessionals. Paraprofessionals who provide instructional services to students, regardless of the titles assigned to them by their LEA, must meet the NCLB's requirements if they:

  2.  
    1. Work in public schools in targeted assistance programs supported by Title I funds or in schoolwide Title I schools; and

    2. Perform activities other than the two activities specifically exempted by the NCLB. Specifically, paraprofessionals must have a high school diploma or its recognized equivalent but do not have to meet the NCLB's other requirements if they:

      1. Are proficient in English and a language other than English and provide services primarily to enhance the participation of children in Title I programs by acting as a translator; or

      2. Have duties that consist solely of conducting parental involvement activities.
