Subject: CEO Memo # 05-06 – INVITATION FOR COMMENTS on the Preliminary Draft Proposal to Amend the Regulations of the Commissioner of Education Regarding Educational Leadership Certificates

In July 2003, the New York State Board of Regents adopted regulations to strengthen the preparation of school leaders. Forty-nine colleges and universities across New York State modified their educational leadership preparation programs (a total of 116 programs) to meet the new standards by September 2004. This transition required extensive effort on the part of presidents, deans, directors, faculty, other administrators, and students at these institutions. I would like to thank those involved for the significant work completed to align educational leadership programs with the new and improved standards.

In May, the Board of Regents discussed a preliminary draft proposal to amend Part 80 of the Regulations of the Commissioner of Education to make the requirements for certification as an educational leader (administrative/supervisory personnel such as school principals, school superintendents, and school business administrators) consistent with the modifications made to education programs last year.

The proposed amendment would establish new names for the certificate titles in educational leadership.

This proposal would also amend Part 80 to establish new education, examination and experience requirements for candidates to qualify for certification as a School Building Leader, School District Leader and School District Business Leader (Attachments A, B and C compare the proposed new certification requirements with the current certification requirements). The proposed amendments to Part 80 (Attachment D) would require all applicants for the new educational leadership certificates to:

  • Complete a registered educational leadership program at an institution of higher education determined by the Department to comply with the new, more rigorous preparation standards required by the Regents in Part 52 of the Commissioner’s Regulations. These programs require candidates to participate in an internship experience working in schools with students at various developmental levels and socioeconomic backgrounds culminating in a 15-week full time leadership experience supervised by experienced school district leaders and program faculty or a substantially equivalent leadership experience.
     
  • Pass a New York State certification examination appropriate to the certificate the applicant is seeking. The Office of Higher Education’s Office of Teaching Initiatives is working with committees of experienced educational leaders around the State, as well as National Evaluation Systems to develop these new certification exams. We anticipate that the first administration of the new certification exams will take place in the summer of 2006. Until final action on the regulations is taken and the examination is administered, graduates of educational leadership programs will continue to receive the SDA, SAS, and the SBA certificates.
     
  • All new Professional certificate holders will be required to perform specified professional development to retain certification.
  • As the Regents discuss this preliminary draft proposal, we are sharing this early draft of the preliminary draft proposal with you for your review and feedback. We welcome your comments and encourage you to share this proposal with other interested colleagues. We anticipate refining the preliminary proposal based on our discussions with the field to develop draft regulations for official public comment in September. The Board of Regents will discuss the draft regulations in November. We will then develop final regulations reflective of the feedback we receive during the official public comment period. We anticipate submitting the final regulations to the Board of Regents for action in December 2005. If adopted, the changes would become effective in September 2006.

    Current certification requirements for School Administrator and Supervisor (SAS)

      For a Provisional certificate – valid for 5 years: For an Initial certificate – valid for 5 years:
    Education Candidate must:
    • hold a Baccalaureate degree
       
    • have earned at least 30 semester hours graduate credit (18 semester hours must be in school administration/ supervision)
       
    • Master’s degree not required until Permanent certificate

    AMENDMENT TO THE REGULATIONS OF THE COMMISSIONER OF EDUCATION

    Pursuant to sections 207, 305, 3001, 3004, 3006, 3009, and 3010 of the Education Law.

    1. Paragraph (1) of subdivision (a) of section 7.1 of the Rules of the Board of Regents is amended, effective _____, 2005, as follows:

    (1) certificates for administrative [and] , supervisory and educational leadership service;

    2. The title of Subpart 80-2 of the Regulations of the Commissioner of Education is amended, effective ______, 2005, as follows:

    REQUIREMENTS FOR [TEACHERS’] CERTIFICATES IN THE CLASSROOM TEACHING SERVICE APPLIED AND QUALIFIED FOR ON OR BEFORE FEBRUARY 1, 2004, THE ADMINISTRATIVE AND SUPERVISORY SERVICE APPLIED AND QUALIFIED FOR ON OR BEFORE SEPTEMBER 1, 2006, AND PUPIL PERSONNEL SERVICE

    3. Paragraph (4) of subdivision (a) of section 80-2.1 of the Regulations of the Commissioner of Education is amended, effective _____, 2005, as follows:

    (4) Candidates who apply for a provisional or permanent [teacher’s] certificate valid for pupil personnel service [or administrative and supervisory service] shall be subject to the requirements of this Subpart.

    4. Paragraph (5) is added to subdivision (a) of section 80-2.1 of the Regulations of the Commissioner of Education, effective _____, 2005, as follows:

    (5) Candidates who apply and qualify for a provisional or permanent certificate in the administrative and supervisory service on or before September 1, 2006 shall be subject to the requirements of this Subpart.

    5. The title of Subpart 80-3 of the Regulations of the Commissioner of Education is amended, effective ______, 2005, as follows:

    REQUIREMENTS FOR [TEACHERS’] CERTIFICATES IN THE CLASSROOM TEACHING SERVICE APPLIED FOR ON OR AFTER FEBRUARY 2, 2004 AND IN THE EDUCATIONAL LEADERSHIP SERVICE ON OR AFTER SEPTEMBER 2, 2006

    6. Subdivision (a) of section 80-3.1 of the Regulations of the Commissioner of Education is amended, effective _______, 2005, as follows:

    (1) Candidates who apply on or after February 2, 2004 for [teachers] certificates valid for classroom teaching service, and on or after September 2, 2006 valid for educational leadership service, shall be subject to the requirements of this Subpart, unless otherwise specifically prescribed in this Part, and except as prescribed in paragraph (2) of this subdivision.

    (2) Candidates who apply for permanent [teachers] certificates in the classroom teaching service or in the administrative and supervisor service shall be subject to the requirements of Subpart 80-2 of this Part, provided that they have been issued a provisional [teachers] certificate in the title for which the permanent certificate is sought.

    (3) Candidates who apply for [teachers'] certificates valid for pupil personnel service [or administrative and supervisory service] shall be subject to the requirements of Subpart 80-2 of this Part.

    7. Subdivision (c) of section 80-3.2 of the Regulations of the Commissioner of Education is amended, effective _____, 2005, as follows:

    (c) The requirements for extensions or annotations of [teachers'] certificates in the classroom teaching service set forth in Subpart 80-4 of this Part shall be applicable.

    8. Paragraph (2) of subdivision (d) of section 80-3.2 of the Regulations of the Commissioner of Education is amended, effective _____, 2005, as follows:

    (2) The certificate forms for pupil personnel service [, and administrative and supervisory service] shall be the forms prescribed in Subpart 80-2 of this Part.

    9. Subdivision (e) of section 80-3.2 of the Regulations of the Commissioner of Education is amended, effective ____, 2005, as follows:

    10. The title of section 80-3.3 of the Regulations of the Commissioner of Education is amended, effective ____, 2005, as follows:

    80-3.3 Requirements for the initial certificate in the classroom teaching service.

    11. Paragraph (1) of subdivision (a) of section 80-3.3 of the Regulations of the Commissioner of Education is amended, effective ____, 2005, as follows:

    (1) Duration. The initial certificate in the classroom teaching service shall be valid for five years from its effective date.

    12. Paragraph (2) of subdivision (a) of section 80-3.3 of the Regulations of the Commissioner of Education is amended, effective ____, 2005, as follows:

    (2) A candidate with a baccalaureate or higher degree who holds a certificate issued by the National Board for Professional Teaching Standards in a title which the department has determined to be equivalent to the title of the initial certificate in the classroom teaching service sought shall be deemed to have met the requirements for such initial certificate prescribed in subdivision (b) or (c) of this section.

    13. The title of section 80-3.4 of the Regulations of the Commissioner of Education is amended, effective _____, 2005, as follows:

    80-3.4 Requirements for the professional certificate in the classroom teaching service.

    14. Subdivision (a) of section 80-3.4 of the Regulations of the Commissioner of Education is amended, effective ____, 2005, as follows:

    (a) General requirements.

    (1) Validity of certificate. The professional certificate in the classroom teaching service shall be continuously valid, provided that the professional development requirement prescribed in section 80-3.6 of this Subpart is met by the professional certificate holder. The professional certificate holder shall be required to meet such professional development requirement to maintain the continued validity of the professional certificate.

    (2) The candidate shall meet the requirements for the initial certificate in the classroom teaching service for the certificate title sought or the requirements for the transitional certificate for career changers and others holding a graduate degree or professional degree, as prescribed in section 80-3.5(a) of this Subpart, for the certificate title sought.

    15. Paragraph (2) of subdivision (a) of section 80-3.6 of the Regulations of the Commissioner is amended, effective _____, 2005, as follows:

    (2) Professional development period means the five-year period commencing on July 1st after the effective date of the [triggering] certificate, and each subsequent five-year period thereafter for the certificate for which the professional development is required.

    16. Paragraph (5) of subdivision (a) of section 80-3.6 of the Regulations of the Commissioner of Education is repealed, effective ______, 2005.

    17. Subdivision (b) of section 80-3.6 of the Regulations of the Commissioner of Education is amended, effective ____, 2005, as follows:

    (b) Mandatory requirement.

    (1) Requirements.

    (i) Requirement for holders of professional certificates in the classroom teaching service. The holder of a professional certificate in the classroom teaching service shall be required to successfully complete 175 clock hours of acceptable professional development during the professional development period.

    (ii) Requirement for holders of level III teaching assistant certificates. The holder of a level III teaching assistant certificate shall be required to successfully complete 75 clock hours of acceptable professional development during the professional development period.

    (iii) Requirements for holders of professional certificates in the educational leadership service.

    (a) The holder of a school building leader certificate in the educational leadership service shall be required to successfully complete 175 clock hours of acceptable professional development during the professional development period.

    (b) The holder of a school district leader certificate in the educational leadership service shall be required to complete 175 clock hours of acceptable professional development during the professional development period.

    (c) The holder of a school district business leader certificate in the educational leadership service shall be required to complete 175 clock hours of acceptable professional development during the professional development period.

    (2) The professional development requirement prescribed in paragraph (1) of this subdivision shall be reduced by 10 percent for each professional development year the certificate holder is not regularly employed by an applicable school in New York.

    (3) The professional development requirement prescribed in this subdivision may be completed at any time during the five-year professional development period.

    (4) Notwithstanding the requirements of paragraph (1) of this subdivision, a holder of a certificate in the classroom teaching service who achieves certification from the National Board for Professional Teaching Standards shall be deemed to have met the professional development requirement, prescribed in this subdivision, for the five-year professional development period in which such national board certification is achieved.

    (5) An individual holding more than one professional certificate in the classroom teaching service and/or educational leadership service shall only be required to complete 175 clock hours of professional development during any five year professional development period. A portion of such professional development must be completed in each of the content areas or related pedagogy of the certificates held.

    18. Subdivision (d) of section 80-3.6 of the Regulations of the Commissioner of Education is repealed and a new subdivision (d) of section 3.6 is added, effective ___, 2005, as follows:

    (d) Acceptable professional development. Acceptable professional development shall be such professional development activities as approved by the applicable school district in New York, pursuant to its professional development plan, as prescribed in section 100.2 (dd) of this Title.

    19. Subdivision (g) of section 80-3.6 of the Regulations of the Commissioner of Education is amended, effective ___, 2005, as follows:

    (g) Reporting requirement.

    [(1) . . .]

    [(2)] Each certificate holder required to complete the professional development requirement pursuant to this section shall report to the executive director of the office of teaching initiatives his or her current mailing address. Each such certificate holder shall report to the executive director a change of his or her mailing address within 30 days of such change. Failure to provide the executive director with a valid current mailing address may result in the suspension of the validity of the teaching certificate or certificates for which professional development is required, as prescribed in subparagraph (h)(2)(ii) of this section.

    20. Subdivision (i) of section 80-3.6 of the Regulations of the Commissioner of Education is repealed and a new subdivision (i) of section 80-3.6 is added, effective ____, 2005, as follows:

    (i) Restoration of validity of certificate(s). To restore the validity of a certificate(s) whose validity has been suspended for failure to satisfy the professional development requirement set forth in this section, the candidate shall be required to demonstrate that he or she has met the deficiency which caused the suspension in validity applicable to the five-year professional development period in which the deficiency occurred consistent with the direction of the Commissioner of Education.

    21. The title of section 80-3.7 of the Regulations of the Commissioner of Education is amended, effective ____, 2005, as follows:

    80-3.7 Satisfaction of education requirements for certification in the classroom teaching service through individual evaluation.

    22. Section 80-3.10 is added to the Regulations of the Commissioner of Education, effective _____, 2005, as follows:

    80-3.10 Certificates for educational leadership service

    (a) School building leader (principal, housemaster, supervisor, department chairman, assistant principal, coordinator, unit head and any other person serving more than 25% of his or her assignment in any building level leadership position shall hold this certificate).

    (1) Initial certificate.

    (i) Validity of certificate. The Initial certificate shall be valid for five years from its effective date.

    (ii) Requirements for an Initial certificate as a school building leader in the educational leadership service. The candidate shall meet the requirements in each of the following clauses:

    (a) Education. The candidate shall meet the education requirement by meeting the requirements in one of the following subclauses:

    (1) The candidate shall have satisfactorily completed a program leading to certification as a school building leader in the educational leadership service pursuant to section 52.21(c)(2) of this Title. As part of the program completion requirements, the candidate shall have been awarded a master’s degree.

    (2) Interstate agreement on qualifications of educational personnel. The candidate may meet the educational requirement by successfully completing a program of preparation for a school building leader or its equivalent at an institution of higher education approved pursuant to section 3030 of the Education Law, the interstate agreement on the qualifications of educational personnel.

    (b) Examination. The candidate shall submit evidence of having achieved a satisfactory level of performance on the New York State assessment of school building leadership.

    (2) Professional certificate:

    (i) Validity of certificate. The Professional school building leader certificate shall be continuously valid, provided that the professional development requirement prescribed in section 80-3.6 of this Subpart is met by the professional certificate holder.

    (ii) Requirements for a Professional certificate as a school building leader in the educational leadership service. The candidate shall have completed, in addition to the requirements for the Initial certificate: three years of teaching and/or administrative and /or supervisory and/or pupil personnel service experience in public or non-public schools N - 12. The candidate who completes this requirement in total or part through providing educational leadership service in New York public schools shall be required to participate in a mentored program in the first year of employment, as prescribed in Part 100 of this Title, unless the candidate has successfully completed two years of educational leadership service prior to such public school service.

    (b) School district leader (superintendent of schools, district superintendent, deputy superintendent, associate superintendent, assistant superintendent and any other person having responsibilities involving general district-wide administration, except school district business leader, shall hold this certificate - holders of a school district leader certificate may not serve as a school building leader unless such individual meets the requirements in subdivision (a) of this section for certification as a school building leader).

    (1) Validity of certificate. The Professional school district leader certificate shall be continuously valid, provided that the professional development requirement prescribed in section 80-3.6 of this subpart is met by the Professional certificate holder.

    (2) Requirements for a Professional school district leader certificate in the educational leadership service. The candidate shall meet the requirements of subparagraphs (i) or (ii) of this paragraph.

    (i) Regular route. The candidate shall meet the requirements in each of the following clauses:

    (a) Education. The candidate shall meet the education requirement by meeting the requirements in one of the following subclauses:

    (1) The candidate shall have satisfactorily completed a program leading to a certificate as a school district leader in the educational leadership service registered pursuant to section 52.21(c)(3) of this Title. As part of the program completion requirements, the candidate shall have earned at least sixty semester hours of graduate study, achieved a satisfactory level of performance on the New York State assessment of school district leadership and have been awarded a master’s degree.

    (2) Interstate agreement on qualifications of educational personnel. The candidate may meet the educational requirement by successfully completing a program of preparation for a school district leader certificate or its equivalent at an institution of higher education approved pursuant to section 3030 of the Education Law, the interstate agreement on the qualifications of educational personnel and achieving a satisfactory level of performance on the New York State assessment of school district leadership.

    (b) Experience. The candidate shall have successfully completed three years of teaching and/or administrative and/or supervisory and/or pupil personnel service experience in public or non-public schools N - 12.

    (ii) Exception to stated preparation. The Commissioner of Education, at the request of a board of education or board of cooperative educational services, may provide for the issuance of a Professional certificate as school district leader to exceptionally qualified persons who seek appointment to serve as a superintendent of schools, who do not meet all of the graduate course or school teaching requirements in subparagraphs (i) of this paragraph, but whose exceptional training and experience are the substantial equivalent of such requirements and qualify such persons for the duties of a superintendent of schools. Prior to the appointment of any such individual, the board must obtain the approval of the commissioner. In its formal request to the department the board must submit its resolution noting approval of the request, the job description, its rationale for requesting such certification of the individual, a statement identifying the exceptional qualifications of the candidate, the individual’s completed application for certification, vitae and official transcripts of collegiate study. The certificate, if issued, will be valid only for service in the district making the request. The commissioner will refer the materials submitted by the board to a screening panel consisting of representatives of the department and appropriate educational organizations for review and advice.

    (c) School district business leader (deputy superintendent of schools for business, associate superintendent of schools for business, assistant superintendent of schools for business and any other person having professional responsibility for the business operation of the school district shall hold this certificate)

    (1) Validity of certificate. The Professional school district business leader certificate shall be continuously valid, provided that the professional development requirement prescribed in section 80-3.6 of this Subpart is met by the Professional certificate holder.

    (2) Requirements for a Professional school district business leader in the educational leadership service. The candidate shall meet the requirements of either subparagraphs (i) or (ii) of this paragraph.

    (i) The candidate shall have satisfactorily completed a program leading to a certificate as a school district business leader in the educational leadership service registered pursuant to section 52.21(c)(5) of this Title. As part of the program completion requirements, the candidate shall have earned at least sixty semester hours of graduate study, achieved a satisfactory level of performance on the New York State assessment of school district business leadership and have been awarded a master’s degree.

    (ii) Interstate agreement on qualifications of educational personnel. The candidate may meet the educational requirement by successfully completing a program of preparation for a school district business leader certificate or its equivalent at an institution of higher education approved pursuant to section 3030 of the Education Law, the interstate agreement on the qualifications of educational personnel and achieving a satisfactory level of performance on the New York State assessment of school district business leadership.

    23. The title of Subpart 80-5 of the Regulations of the Commissioner of Education is amended, effective _____, 2005, as follows:

    REQUIREMENTS RELATING TO CLASSROOM TEACHING AND EDUCATIONAL LEADERSHIP PRACTICE AND SPECIALIZED CREDENTIALS.

    The title of section 80-5.13 of the Regulations of the Commissioner of Education is amended, effective _______, 2005, as follows:

    80-5.13 Alternative [teacher certification] requirements for classroom teaching certificates.

    25. Section 80-5.15 is repealed and a new section 80-5.15 is added to the Regulations of the Commissioner of Education, effective ____, 2005, as follows:

    80-5.15 Alternative requirements for school district leader certificates.

    (a) Requirements for Transitional D certificate for service as a school district leader, applicable for a candidate enrolled in an alternative school district leader certification program pursuant to section 52.21(c)(4) of this Title.

    General requirements.

    (i) Time validity. The transitional D certificate shall be valid for three years from its effective date.

    (ii) Limitations. The transitional D certificate shall authorize a candidate to serve as a school district leader only in a school district for which a commitment for employment and mentoring has been made. In addition, it shall only be valid as long as the candidate is matriculated in good standing in a registered alternative school district leader certification program leading to a professional certificate.

    Demonstrated potential through prior leadership experiences.

    The candidate shall submit evidence demonstrating his or her potential to become a school district leader as a result of at least three years’ exceptional service in a leadership position in an organization or organizations that demonstrated strong performance. Such experience must be the substantial equivalent of three years experience as a teacher, administrator, or pupil personnel service provider in a public or non-public school. Through this equivalent prior experience, the candidate shall demonstrate the following accomplishments:

    (i) developed and promoted a vision for an organization;

    (ii) collaboratively identified goals and objectives for achieving that vision;

    (iii) communicated effectively to promote goals;

    (iv) lead comprehensive long-range planning, informed by multiple data sources for achieving goals;

    (v) effected any needed change through ethical decision making based upon factual analysis even in the face of opposition;

    (vi) established accountability for achieving goals and objectives;

    (vii) developed staff capability for their roles in achieving goals;

    (viii) supervised establishment of a budget supporting achievement of goals;

    (ix) supervised the management of finances and facilities to support achievement of goals; and

    (x) applied statutes and regulations in accordance with law and developed and implemented policies in accordance with law.

    Education. The candidate shall meet the following requirements:

    (i) The candidate shall hold a graduate degree (academic or professional) from an accredited institution of higher education or from an institution authorized by the Board of Regents to confer degrees.

    (ii) The candidate shall submit satisfactory evidence of matriculation in registered alternative school district leader certification program leading to a professional certificate.

    (iii) The candidate shall submit evidence of the registered alternative school district leader certification program’s endorsement for a transitional D certificate, including the program’s description of how the candidate met each criterion used by the program to determine that the candidate had exceptional qualification for becoming a school district leader with the substantial equivalent of three years of experience as a teacher, administrator, or pupil personnel provider in a public or nonpublic school.

    (4) Examination. The candidate shall submit evidence of having achieved a satisfactory level of performance on the New York State assessment of school district leadership.

    (5) Employment and support commitment. The candidate shall submit satisfactory evidence of a written commitment from a school district or BOCES for district mentored and college supervised employment as a school district leader, with mentoring of candidates for superintendent of schools to be provided by the regional BOCES District Superintendent or the New York City Regional Superintendent, or a superintendent identified by the regional BOCES District Superintendent or New York City Regional Superintendent, subject to the approval of the employing authorities.

    (b) Requirements for the professional certificate as a school district leader, applicable for a candidate holding a transitional D certificate and matriculated in an alternative school district leader certification program pursuant to section 52.21(c)(4) of this Title.

    (1) Education. The candidate shall have successfully completed a registered alternative school district leadership program leading to a professional certificate. Upon program completion, the candidate shall have successfully completed at least 60 semester hours of graduate study that may include graduate study completed prior to admission to the registered alternative school district leadership program and the graduate study completed in such program.

    (2) Experience and mentoring. The candidate shall submit evidence of having had at least three school years of full-time service as a school district leader that was mentored, obtained through an alternative school district leader certification program registered pursuant to section 52.21 ( c) (4) of this Title.
