ADVISORY COUNCIL MEETING
September 6, 2001
Minutes

The following members were present: Anthony Stanziani, John Austin, Michael Hatten, Arthur Resso, Yerachmiel Barash, Vincent Ferrara, James Devaney, Howard Goldsmith, Wayne Wagner, and Cindi Frieder. The meeting was held at 116 West 32nd Street, 7th Floor, New York, New York and begin at 10:00 a.m.

  1. The meeting minutes for the meeting held on July 12, 2001 at IKON, Latham, New York were approved by the Council.
  2. Howard Goldsmith updated the Council on the recent consumer advocacy piece that was aired on Channel 4 in NYC regarding the tremendous unlicensed school problem. BPSS Supervising Investigator Edward Kramer was interviewed by the reporter along with some students that were attending unlicensed schools. Ed advised students to attend only licensed schools since BPSS can verify standards and protect students through the Tuition Reimbursement Account (TRA). The students interviewed by the reporter had no recourse.
  3. David Brieff gave a short presentation regarding Mike Hatten’s letter of July 20, 2001 in which guidance counselors were coding high school students who attended proprietary schools as unsuccessful graduates. Dave spoke with a NYC guidance counselor who clarified that students who go on to attend a vocational program are not considered unsuccessful, but are simply categorized for recordkeeping purposes.
  4. Anthony Stanziani followed up on the clock vs. credit hour issue. He spoke with representatives from the Association of Proprietary Colleges. He advised the Council that the Association informed him that they would not support an initiative allowing the non-degree sector to use the term "credit hour" in their course offerings. They also said they would not oppose it too diligently.
  5. James Devaney advised the Council that he spoke with State regulators in Ohio who use credit hours in their sector. Jim is to obtain further information and share it with Council members.
  6. The remaining issues for the Council focused on Regulatory Reform and the initiatives of BPSS to move forward with Regents approval to amend Part 126 of the Regulations of the Commissioner of Education. Certain individuals who submitted materials through BPSS to the Council prior to the meeting addressed the Council regarding their relevant issues of concern. The following people addressed the Council in regards to regulatory reform:

  8. Anthony Stanziani provided each AC member with a list of issues being considered for regulatory reform. Each AC member prioritized the list of items and Anthony collated the results as follows:
    1. Use of "credit hours" in addition to clock hours.
    2. Alternative licensing methods for teachers.
    3. Credit to business teacher applicants who attend proprietary schools.
    4. Core requirements for programs.
    5. Electronic attendance.
    6. Streamline recordkeeping.
    7. Elimination of the need for licensed school directors to also have an agent’s license to enroll students.
    8. Temporary approval for curriculum to deal with RFP and/or WIA contacts.
    9. Require e-mail access for all schools.
    10. Establish proper entrance requirements for students attending Computer Training Facilities.
    11. Add some guidelines/requirements for distance education programs.
    12. ESL schools shall be brought into parity with other schools under Article 101 of the Education Law and Part 126 of the Commissioner’s Regulations.
  1. Howard Goldsmith explained the process of Regents review for discussion and action by the Regents on Regulatory Amendments. BPSS will try to have a rough draft of the Part 126 regulations available for the next Advisory Council meeting.
